By submitting your item for repair at Bag Spa, you are participating in our service and agree to be bound by the general terms and conditions, including any additional terms.
These terms apply to all users who enter into an agreement with Bag Spa.
Please read these terms carefully before using our service.
By using our service and signing the intake form (either in person or digitally), you agree to be bound by these terms.
GENERAL TERMS AND CONDITIONS
By agreeing to these terms, you declare that you are at least of legal age, or that you are of legal age and have given us permission to allow any minor dependents to use this service.
You may not use our service for illegal purposes, nor may you, when using the service, violate laws (including but not limited to copyright laws).
A breach of any of the Terms will result in the immediate termination of the services provided to you.
ACCURACY OF INFORMATION
We are not responsible for information made available on this site that is inaccurate, incomplete, or not up-to-date. The material on this site is for general information purposes only and should not be relied upon as the sole basis for making decisions without consulting primary, more accurate, complete, or up-to-date sources of information. Any reliance on the material on this site is at your own risk.
We reserve the right to modify the content of this site at any time, but we are not obligated to update the information on our site. You agree that it is your responsibility to monitor changes to our site.
The trade name Bagspa is a BIOP registered trademark established in the Netherlands and may not be used by any third party in the Benelux under any circumstances.
Inspection of Items and Possible Changes to Your Quote:
We may accept your items and then revise the quote.
If, after a further inspection, we determine that we can only fulfill your order based on an alternative quote and not the indicative quote previously provided, we will contact you as soon as possible.
At this stage, we offer you the option to cancel the order or a part of it or to proceed with it.
If you accept the revised quote, we will send you an email confirming our acceptance of your order according to the revised quote, at which point a binding legal contract will come into effect. If you do not accept the revised quote, we will return your items and charge a processing fee of €25 and return shipping costs.
Services Offered by Bag Spa
Cleaning:
Our specialized and unique cleaning techniques often yield excellent results.
We have handled many bags over the years and have almost seen everything in our workshop.
We promise to work with great expertise, but unfortunately, we cannot guarantee the removal of the following: stains, defects, and errors unrelated to your items.
This includes hidden stains, defects, and errors that become apparent during the cleaning, repair, or restoration process.
We also cannot guarantee that we will be able to conceal or remove natural defects or achieve any other desired outcome.
(However, we are always willing to discuss this to reach a satisfactory final result.)
Please also note that despite our efforts, any attempt to clean, repair, or restore your items may exacerbate or make hidden defects, stains, or errors more visible.
We are not liable for such damage.
Please be aware that you are personally responsible for the risks associated with all treatments performed on your items.
In particular, we note that with age, leather and suede handbags can wear out and discolor.
Dirt on the item can sometimes hide this wear, which may be exposed during the cleaning process. If this occurs, you will be notified, and an upgrade of your service will be offered to restore the color in these areas where possible.
It is not our cleaning process that caused this damage, and therefore we are not liable for it.
Dirt may also be mistaken for gloss, which is removed during the cleaning process. Bag Spa is not responsible for the loss of gloss during the cleaning process.
(However, we usually have a suitable solution available and/or are willing to consider this with the customer.)
Stain Removal:
Unfortunately, we cannot guarantee that all stains will be removed.
Linings that have become extremely dirty over the years can be particularly difficult to clean to satisfaction.
The base price of cleaning does not include the removal of heavy or ingrained stains. If a stain cannot be removed from a leather item, we will do our best to cover the stain with the appropriate color. This process cannot be performed on suede or fabric. This service is not included in the agreed price.
Restoration Work and Dyeing:
During color restorations, we cannot guarantee that any contrast-colored stitching will remain untouched. Since these stitches are usually made from beautiful but delicate materials such as wool or silk, it is possible that the dye may be absorbed into them.
(However, we always ensure that this is done evenly, in the color of the bag.)
The more labor required to restore your item, the more processes and products are needed.
This may, in certain circumstances, slightly alter the way your bag feels. We will always strive to keep the item as close to the original as possible.
Restoration Time:
Our estimated turnaround time for the service is more than 5 weeks, depending on which services are requested. However, more complex tasks may take longer. Please allow 6-8 weeks.
Bag Spa cannot be held responsible for delays in service caused by unforeseen circumstances or additional requirements.
Delivery:
Bag Spa accepts shipments from all courier companies and prefers insured shipments.
This is because Bag Spa is not responsible for any loss or damage of the shipped items.
We also offer the option to schedule an appointment via www.bagspa.nl/agenda to deliver your items in person.
PERSONAL INFORMATION
Submitting personal information via both the website and by phone is governed by our Privacy Policy. We will handle this with the utmost care.
PROHIBITED USE
In addition to other prohibitions outlined in the Terms of Service, you are prohibited from using the site or its content: (a) for unlawful purposes; (b) to solicit others to perform or participate in unlawful acts; (c) to violate international, federal, provincial, or state regulations, rules, laws, or local ordinances; (d) to infringe upon or violate our intellectual property rights or the intellectual property rights of others.
We reserve the right to terminate your use of the Service or any related website for violating any of the prohibited uses.
WARRANTIES:
We do not guarantee that the use of our service will be completely problem-free or that underlying issues with your items will be revealed by using the service.
You expressly agree that your use of our service is at your own risk.
Nevertheless, at Bag Spa, with our love for bags and years of expertise, we always have your items’ best interests at heart: we always strive for a beautiful but, above all, natural result!
Under no circumstances will Bag Spa, our employees, affiliates, interns, suppliers, be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including but not limited to lost profits, lost revenue, missed savings, loss of data, replacement costs, or similar damages, whether based on contract, tort (including negligence), strict liability, or otherwise, arising from your use of any of the services or products purchased using the service, or for any other claim related in any way to your use of the service, including but not limited to any errors or omissions in any content, any loss or damage of any kind incurred as a result of the use of the service or any content posted, transmitted, or otherwise made available via the service, even if advised of the possibility of such damages.
Because some states or jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, our liability in such states or jurisdictions is limited to the maximum extent permitted by law.
Indemnification:
You agree to indemnify, defend, and hold harmless Bag Spa, affiliated service providers, suppliers, interns, and employees from any claim or demand, including reasonable attorneys’ fees, made by a third party due to or arising out of your violation of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third party.
If any provision of these Terms of Service is found to be illegal, void, or unenforceable, such provision will nonetheless be enforceable to the extent permitted by applicable law, and the unenforceable portion will be deemed to be severed from these Terms of Service, and such determination will not affect the validity and enforceability of any remaining provisions.
Termination of Agreement:
Please note that we reserve the right to terminate our agreement in the event of misconduct (discrimination, threats, or severe suspicion) without providing a reason.
Bag Spa is a company that values respect highly; any person who does not interact respectfully with Bag Spa and/or employees will receive immediate termination.
These terms posted on this site or related to the service constitute the entire agreement and understanding between you and Bag Spa and govern your use of the Service, and supersede all prior or contemporaneous agreements, communications, and proposals, whether oral or written, between you and us (including but not limited to prior versions of the Terms of Service).
Any ambiguities in the interpretation of these Terms of Service shall not be construed against Bag Spa.
Governing Law:
These Terms of Service and any separate agreements whereby we provide you Services will be governed by and construed in accordance with Dutch law.
